By accessing or using Acardai (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes by email at least 30 days in advance and by posting a notice on the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.

Acardai provides software tools designed to help users track credit card benefits and receive informational suggestions about credit card usage based on user-provided data.

Informational Purposes Only

The Service, including any recommendations, suggestions, or analyses provided, is for informational purposes only and does not constitute financial advice, investment advice, tax advice, or any other form of regulated financial guidance. Acardai is not a registered investment advisor, financial planner, or credit counselor.

Verify Independently

Credit card earn rates, benefits, and terms change frequently. While we strive to maintain accurate information in our card catalog, Acardai does not guarantee the accuracy, completeness, or timeliness of any card data. Users should independently verify all card terms directly with their card issuer before making any financial decisions.

No Guarantee of Results

Use of the Service does not guarantee any specific financial outcome, savings, rewards earned, or benefits received.

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent that you are 18 or older.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

We reserve the right to terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any portion of the Service or any other system connected to the Service
• Scrape, crawl, or use automated tools to extract data from the Service without our written permission
• Reproduce, resell, or commercially exploit any portion of the Service without our written permission
• Upload or transmit any malware, viruses, or other malicious code
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein
• Attempt to probe, scan, or test the vulnerability of the Service or breach any security or authentication measures

Free Tier

Acardai offers a free tier with limited features as described on our pricing page. We reserve the right to modify or discontinue the free tier at any time with 30 days notice.

Paid Subscriptions

Premium and any other paid tiers are billed in advance on a monthly basis. All fees are stated in US dollars and are non-refundable except as described in the Refund Policy below.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. We will charge your payment method on file for the applicable subscription fee plus any applicable taxes.

Price Changes

We may change subscription prices with 30 days advance notice. Price changes will take effect at the start of your next billing period following notice.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting [email protected]. Upon cancellation, you will retain access to paid features through the end of your current billing period.

Refunds

We offer a full refund within 7 days of any charge. Refunds after 7 days are at our discretion and will be evaluated on a case-by-case basis. To request a refund, contact [email protected].

Acardai Content

The Service and its original content (excluding user-provided data), features, functionality, design, and software are owned by Acardai LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

User Data

You retain ownership of all data you provide to the Service (“User Data”). By providing User Data, you grant Acardai a limited, non-exclusive license to use your User Data solely to operate and provide the Service. We do not sell your User Data.

Card Data Disclaimer

Credit card earn rates, benefits, annual fees, and related information displayed in our catalog are factual data compiled from publicly available issuer sources. Credit card names, issuer names, and trademarks belong to their respective owners. Acardai is not affiliated with, endorsed by, or sponsored by any credit card issuer.

Feedback

If you provide us with feedback or suggestions about the Service, you grant us an unlimited right to use such feedback for any purpose without compensation to you.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Acardai does not warrant that:

• The Service will function uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Card data or recommendations will be current, accurate, or complete
• Any errors in the Service will be corrected

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions may not apply to you.

To the maximum extent permitted by applicable law, in no event shall Acardai, its officers, directors, employees, agents, or successors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service, including card data or recommendations
• Unauthorized access, use, or alteration of your data

In no event will our total liability to you exceed the greater of (i) the amount you paid to Acardai in the twelve months preceding the claim or (ii) one hundred dollars ($100).

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) even if Acardai has been advised of the possibility of such damages.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Informal Resolution

Before filing any legal claim, you agree to contact us at [email protected] and attempt to resolve any dispute informally for at least 30 days.

Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court, except that either party may bring claims in small claims court for eligible disputes.

By agreeing to arbitration, you waive your right to a jury trial.

Class Action Waiver

You agree that disputes will be resolved only on an individual basis and not as a class action, consolidated action, or representative proceeding.

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion.

Upon termination, your right to use the Service will cease immediately. Sections 6 through 9 of these Terms will survive any termination.

We will notify you of material changes at least 30 days in advance via email. A summary of changes will be posted on the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
